What legal DNA testing is and when it's required
Legal DNA testing is required when the result may be used for court, custody, child support, immigration (including USCIS matters), birth certificate updates, adoption, guardianship, inheritance claims, or benefit applications. What separates legal testing from informational testing is chain of custody: photo identification verification, witnessed sample collection, tamper-evident sample handling, and documented transport to the lab. Without chain of custody, DNA results are not accepted by courts, agencies, or government offices.
A legal DNA test requires verified ID, documented collection, secure handling, and chain of custody. Contact My Forever DNA®.
Why chain of custody exists
The party using DNA results in a legal matter has to prove that the samples came from the specific people named on the report. Chain of custody documents each step: who was tested, how their identity was verified, who collected the samples, how the samples were sealed and transported, and how they were handled at the lab. Every link in that chain is traceable to a specific person at a specific time. An at-home kit skips all of these steps, which is why at-home results are informational only.
Legal Testing We Offer at the Omaha Office
Test types available with legal chain of custody
-
Legal Paternity DNA Test: for custody, child support, birth certificate updates, and any father-child documentation.
-
Legal Maternity DNA Test: for adoption, IVF documentation, immigration, birth records, and mother-child verification.
-
Legal Grandparent DNA Test: when the alleged parent is unavailable, deceased, or refuses to participate.
-
Legal Sibling DNA Test: for full sibling, half sibling, or no-sibling determinations tied to inheritance or benefit claims.
-
Legal Aunt or Uncle (Avuncular) DNA Test: alternate path when a parent sample can't be collected.
-
Legal Twin Zygosity DNA Test: identical vs. fraternal determination for medical or documentation purposes.
Each legal test uses the same lab methodology as its informational counterpart (see Tabs 5 and 6 for the relationship-specific accuracy details). What changes is the collection process, not the science.
Immigration and USCIS-Related Testing
Special handling for immigration cases
Immigration DNA testing has requirements that can differ from other legal DNA testing. USCIS, consulates, and embassies may specify particular AABB protocols, sample handling procedures, or delivery formats. Do not begin with a standard at-home kit if immigration is involved. Call the Omaha office at 402-800-7161 before scheduling so we can confirm your specific case requirements and coordinate with the requesting agency or attorney.
When to also involve your attorney
Requirements vary by court, state, agency, and case type. Confirm your exact documentation needs with your attorney or the agency requesting the DNA test before scheduling. We provide the testing service; we do not provide legal advice.
Responsible Use Disclaimer: Requirements vary by court, agency, attorney, or case type. My Forever DNA® provides DNA testing services and support but does not provide legal, medical, or immigration advice.
